10.a Swensons Goose Lake Farm Estates HOA Petition to Keep Public EasementRECEIVED AUG 16 Z VI CI -T-1, OF SCANDIA PETITION IN ORDER TO KEEP THE PUBLIC WAY FOR PEDESTRIAN USE IN SWENSO ' E—tAKF-TAI ESTATES FROM OREN ROAD NORTH TO GOOSE LAKE IN THE CITY OF SCANDIA, COUNTY OF WASHINGTON, MINNESOTA. (Resolution No. 2021-37) TO: The City Council of City of Scandia, Minnesota The undersigned, home owners of lots 1 through 4 and/also all members of the Swenson's Goose Lake Farm Estates Homeowners Association, as set forth opposite their respective names, abutting an easement in Lots 1 through 4, Block 1; Outlots A, B, and C for pedestrian way for purposes over and access as defined as: The East 20.00 feet of Lots 1 through 4, Block 1; Outlots A, B, and C, all in the recorded plat of SWENSON'S GOOSE LAKE FARM ESTATES, Washington County, Minnesota. Mr. Swenson and Mr. Simpson stated in their petition to vacate the easement "the Easement is not currently used by members of the public for access to Goose Lake". This statement is totally false. The access trail to the lake is being maintained at the present time by the members of the Swenson Goose Lake Farm Estate Home Owners Association and is being used as access to Goose Lake. Furthermore, the development was advertised that purchasers of the properties would have a "Nature Park and Walking Trail to Goose Lake". (See Attachment #1) This was also a bonus factor in our decision to purchase the properties and remains a plus factor if and when we sell. Mr. Swenson and Mr. Simpson's petition to vacate the portion of the Easement legally described as The East 20.00 feet of the Northwest Quarter of the Southwest Quarter and that part of the east 20.00 feet of the Southwest Quarter of the Southwest Quarter lying North of the South 468.27 feet thereof, All in Section 11, Township 32 North, Range 20 West, Washington County, as depicted in Exhibit 2 of Mr. Swenson and Mr. Simpson's petition. If their petition is accepted and later granted our properties and the public will no longer have access to Goose Lake via this trail. We respectfully petition the city council NOT to accept Mr. Swenson and Mr. Simpson's petition to vacate the aforesaid public way.
