PO Box 128, Scandia, Minnesota 55073 Phone (651) 433-2274 Fax (651) 433-5112 http://www.ci.scandia.mn.us MEMORANDUM DATE: October 19, 2021 TO: Honorable Mayor and City Council FROM: Ken Cammilleri, City Administrator RE: Other Ordinance Update Considerations and October Administrator Report Ordinance Updates Garbage Collection The drafting process for nuisance regulations has revealed the need to revisit the City’s refuse collection regulations. These regulations can be found in Section 52 of the Code of Ordinances and have been in effect since 1970. However, it appears that these requirements have not been actively enforced or applied in several years. Recent damages to roads and noise concerns has raised cause to re-evaluate these regulations. The licensing mechanism within the existing regulations present an opportunity to maintain accountability for road damage and responsibility for operations. It also gives the City Council the discretion to set the days and hours for collection activities, which can be useful for managing the timing of noise disturbances and limiting the weekly frequency of hualing for each hauler which can contribute to road deterioration overtime. If the Council agrees to the continuation of this ordinance, staff will proceed with preparations for the permitting process and will send notice to area haulers. Some cleanup to this code will be needed. For example there are obsolete references to the use of a dump in May Township and the permit fee should be included within the fee schedule. In addition, there needs to be clearer conditions for accepting haulers, a hearing process and conditions for haulers facing revocation or sanctions, and a distinction between commercial and residential hauling. An optional, but sometimes included provision of these types of regulations is to introduce City Council approved rates. Typically, these regulations restrict haulers from introducing rate changes unless they are supported by changes in fuel costs, landfill tipping fees, and labor costs. The City could also consider limiting the number of available licenses or maintain no limits. Park Regulations Page 2 of 2 City of Scandia 14727 209th St. N. Some changes intended to implement reasonable exceptions to different provisions of the ordinances have created some unintended changes. For example, the use of ATVs in the parks is generally prohibited on all city parks, except at Bone Lake. ATV use in this park has caused ruting damage to trails and disturbance to soils where these vehicles have gone off trail. Recommended changes to this ordinance will also be presented at an upcoming meeting. Drafting of the Unified Development Code A special joint meeting of the City Council and Planning Commission will be scheduled later this month and next month to continue the review process. The group has reviewed the following sections: - Allowable Uses Building - Building and Zoning District Design & Charactor - Administration (Procedure and Definitions) Please remember, if you have any concerns, thoughts or comments regarding anything that has been reviewed, it is not too late to address them. Please forward any of your comments and concerns, and these will be forwarded to SHC. Discussion of these issues will be made at the next scheduled meeting. Internet Expansion The directed funded Quality Trail Buildout Project has completed conduit installation just south of 202nd Street N on St. Croix Trail N. Public Works Director Fischer has been working with 3rd Party inspection verification firm Connected Nation to arrange project inspection. The company is used by the State of Minnesota for broadband internet buildout grants. Code Enforcement There has been a recent increase in shoreland and wetland related construction violations. Property owners are reminded that they should contact City Hall to determine if planned projects are permissible under government regulations. City Staff work closely with our other regulatory agencies, and can help coordinate any inquiries, so property owners can confirm a project is allowed. Please do not hesitate to reach out!
