06.i Staff report - Tobacco License Scandia Olde Towne Liquor Staff Report Date of Meeting: January 18, 2022 To: City Council From: Brenda Eklund, City Clerk Re: Tobacco Products Sales License for Change in Ownership – Scandia Olde Towne Liquor Background: Chapter 111 of Scandia’s Code of Ordinances regulates the sale and use of tobacco products within the City of Scandia. Upon receipt of a completed application, the Clerk shall forward the application to City Council for action at its next regularly scheduled meeting. The City Council may either approve or deny the license, or it may delay action for such reasonable period of time as necessary to complete any investigation of the application or the applicant it deems necessary. If the City Council approves the license, the Clerk shall issue the license to the applicant. If the City Council denies the license, notice of the denial shall be given to the applicant along with notice of the applicant’s right to appeal the Council’s decision. Issue: Should a Tobacco Products Sales License be approved for the business Scandia Olde Towne Liquor that will have a change in ownership effective February 1, 2022? Proposal Details: The business Scandia Olde Towne Liquor has been approved for the sales of tobacco products by the City of Scandia since 2007, and by Washington County in years prior under New Scandia Township. The new business owner Roxanne Bluhm proposes to take over the business on approximately February 1, 2022, and has applied for a 2022 tobacco products sales license for this change in ownership. The application meets all the requirements of the City’s ordinance regulating the sale and use of tobacco products. The license fee has been paid. Upon completion of the required investigation of the new owner, the Sheriff’s office found no reasons not to approve the license for Scandia Olde Towne Liquor. If approved, the license shall be valid for the current calendar year. Options: 1) Approve the tobacco products sales license for Scandia Olde Towne Liquor effective with the proposed change in ownership on February 1, 2022. 2) Delay action on the tobacco products sales license application. 3) Do not approve the tobacco products sales license application. Recommendation: Option 1.
