06.d Staff report - Scandia Elementary PTO Gambling Permit Staff Report Date of Meeting: April 19, 2022 To: City Council From: Brenda Eklund, City Clerk Re: Scandia Elementary PTO Application for an Excluded Raffle Permit Background: The Scandia Elementary PTO has applied for an Excluded Raffle Permit for their fundraising event planned for April 29, 2022, as part of the school’s Spring Carnival. The Gambling Ordinance, Chapter 130.01-130.99 of the City’s Code of Ordinances, requires a local permit to conduct lawful gambling that is excluded or exempted from state licensure requirements. Issue: Should the City approve Scandia Elementary PTO’s application for an Excluded Raffle Permit? Proposal Details: The organization will sell raffle tickets for prizes. The value of all prizes given will be $1,200. State law allows an excluded raffle to be conducted by a nonprofit organization if the total value of all raffle prizes awarded does not exceed $1,500 and the organization has not received an exempt permit in the current calendar year. The PTO’s nonprofit status with the Secretary of State’s Office has lapsed due to inactivity, but the PTO Treasurer is working on reinstatement. Staff recommends the Raffle Permit be approved conditioned on the PTO being reinstated to non-profit status before the carnival date (April 29, 2022). Otherwise, the organization and the event appear to meet all the requirements of the city’s ordinance. Fiscal Impact: The $15 application fee has been paid. Options: 1) Approve Scandia Elementary PTO’s Excluded Raffle Permit conditioned on the PTO being reinstated to non-profit status before the carnival date (April 29, 2022). 2) Do not approve the request for a gambling permit. 3) Make no decision at this meeting. Recommendation: Option 1.
