They are requesting a minor subdivision to create a ten-acre parcel on one of the existing 40-acre parcels along Olinda Trail that would include the existing home and accessory structures. They are working with the Minnesota Land Trust to create a permanent conservation easement on the remaining 290 acres. The applicants have discussed potential future ownerslup of the easement area with the Minnesota DNR. The applicants are requesting a variance to allow creation of the 10-acre parcel on one of the existing 40-acre parcels in the Agriculhue Core (AG C) District, and to preserve some of the existing accessory buildings on that 10-acre parcel. DETAILED EVALUATION OF THE REQUEST: Comprehensive Plan The subject property is designated Agriculture Preserves and Agricultural Core on the Future Land Use map included in the Comprehensive Plan. (Parcels included in Agricultural Preserves are at the south end of the property, and indicated on the map attached,) The Agriculture Preserves status of the parcels enrolled in that program expired on May 7, 2010,but the zoning sta.tus remains. The Comprehensive Plan includes the following goals related to the AG Core District that are relevant to the proposed subdivision request: � The plan encourages lot sizes that will support continuation of agricultural land uses. • The plan encourages protecting a�n�icultural production as a long-term land use, and encourages long- term protection of agricultural lands and open space through conservation easements, the Agriculture Preserves program, Open Space Conservation Subdivisions and similar pro�rams. • The plan also encourages preservation of historic agricultural structures in order to support long-term agriculture use and maintain the rural character of Scandia. • The plan encourages protection and restoration of natural resources and wildlife habitat. • The applicants are proposing to place a permanent conservation easement on 290 of the 300 acres that they own. The conservation easement would be held and monitored by the Minnesota Land Trust. The applicants have discussed potential transfer of the easement area to the Minnesota DNR in the future. Minnesota Land Trust staff indicated that the following uses will be alIowed in the area under the conservation easeznent: • Continuation of agriculture use on the existing cultivated fields. • Restoration of some or all fields to native grassland,with a management plan. • Wildlife management,including hunting. • Limited timber harvest in woodland areas with a management plan. • Protection or expansion of stream buffers. • Primitive(non-paved)trails. ATV's or other motorized use would only be allowed to use the area to support agricultural activities or habitat martagement. • Recreation and educational uses with minimal impacts. • Benches or rustic structures related to recreation could be placed on the property. No future residential, commercial or industrial use or structures would be permitted under the easement. No utilities may be developed on the property. The proposed subdivision is consistent with the intent and man o�f thegoals in#he Comprehensive Plan. However it is not consistent with the recommended lot sizes for the A�riculture Core District recommended in the Comprehensive Plan The pucpose of the lot size recommendations in the AG C District is ta support continuation of a�ricultural uses. i Heinisch Minor Subdivision and Variance Page 3 November 1,2011 Scandia,Minnesota • Density The maximum density for conventional subdivision in the AG C District is 4 units per 40 acres. The subject property includes 300 acres and would create a new 10-acre parcel with one dwelling unit and preserve the remaining 290 acres in eight parcels with no existing vr future dweliing units. Theproposed subdivision meets the densitv standard of the AG C District. Lot Size and Frontage The Development Code requues that new lots in the AG C District be 2 to 5 acres in size, or 20 acres or greater in size. The code allows lot sizes in Open Space Conservation Subdivisions(OSCS)to vary from the specified sizes. The code indicates that the minimum lot size in an OSCS is 1.5 acres; no inaximum lot size is identif ed. Minimum frontage on a public street is required as follows: lots 2 to 3 acres must have a fronta.ge of 160 feet, lots 3 to 4 acres must ha�e 240 feet,and larger lots must have 300 feet. The propased new parcel would have a lot size of 10 acres, and a frontage of approximately 600 feet on Olinda Trail North. The nroposed�arcel does not meet the lot size requirement in the AG C district,but does meet the fronta�e requirements The applicants have requested a variance fi•om the lot size standard to permit creation of the 14-acre parcel. Accessory Slructures � There are 14 existing significant accessory buildings on the site (excluding miscellaneous small sheds). The structures include barns, sheds, silos,and a detached garage. The structures are located on the parcel proposed for subdivision(identified on attached figure). The total area of the 14 accessox•y structures is approximately 34,000 square feet. The Development Code allows a maximum 2 accessoiy structures and total 2,500 square feet of accessory structures on lots of 10 to 20 acres in size. The ordinance limitations on the number and size of accessory structures on lots less than 40 acres in size is designed to prevent potential futz.�re incompatible uses on these parcels. Other communities have recently addressed sites where non-agricultural uses such as trucking businesses,auto repair businesses,and large kennel operations have begun operation in larger accessory buildings in zones where these businesses are not pea•mitted. The applicants highlighted the two tradirional hip-roofed barns that aze hand-hewz►,wood pegged structures in the application. The total area of the two barns is approximately 8800 square feet and the area of the detached garage is approximately 600 square feet. The applicants indicated verbally that they would like to keep most or all of the accessory structures on the parcel. Wetlands There axe no wetlands within the proposed 10-acre parcel. No new development is proposed on the paxcel. Existing wetlands on the 290-acre parcel are shown on Exhibit B submitted with the application. Scandia, Minnesota Setbacks The required setbacks are front yard of 40 feet, side yard of 20 feet, and rear yacd of 50 feet. The existin� structut•es zneet the required setbacks and no new buildin�s are proposed. Buildable Area No new buildings are proposed on the new or existing parcels. Wastewater Trentr�zenl The existing homestead is served by an on-site septic system. No new uses that would require wastewater treatment are proposed. Stormwater Management No alteration is proposed in the grades on the site, and no new impervious surfaces are proposed. Access The existing driveway is located on Olinda Trail,a county roadway. The application was referred to the County for comment, as required by the Development Code. The County's letter dated October 15, 2011 indicates that no impacts or concerns were identified for Olinda Trail. � Easements Minnesota Land Trust staff indicated that the property owners are proposing to piace a permanent conset•vation easement on the 290 acres of the property outside the 10-acre homesite. The conservation easement would be held and managed by the Land Trust. The applicants have discussed eventual sale of the property with the easement to the Minnesota DNR with staff of the agency. The easement would allow for a variety of agricultural, recreational and open space uses, and would prohibit any residential,commercial or industrial development on the property in perpetuity. The easement would allow for public use of the property for recreational and educationai purposes, and the applicants are willing to allow public use of the property. Park Dedication Pat'k dedication is required for new subdivisions. The City has th�option to obtain park Iand or collect the fee in lieu of land($3,0�0). The property is not within a Park Search Area per the Comprehensive Plan, so the City could propose to collect the park fee of$3,000 in lieu of land. However,the applicants are proposing that the area within the conservation easement be open to the public for passive recreational use such as walking, biking,horseback riding, and nature observation. The Parks Committee is scheduled to discuss the application at their meetin�on Noveinber 7, after the Plantiin�Commission and befare the Caunci] meeting on November 15. This will allow the Committee to make a recomm.endation re�ardin�potential park dedication requirements. The Planner recommends that the Cit�onsider waiving.the park dedication requirements if the conservation easement and owners allow public use of the prQperty. • Heinisch Minor Subdivision and Variance Page 5 November 1,2011 Scandia, Minnesota • DETAILED DISCUSSION OF THE VARIANCE REQIIEST The State of Minnesota has recently passed legislation modifying the statute regarding variances. The City Attorney has advised that we use the new state language for this application,and that the City's ordinance be updated to include the new state language related to the criteria for granting a variance. The new language states tha# "Variances shall only be permitted when they are in harmony with the general purposes and intent of the nfftcial control and when the variances are consistent with the comprehertsive plan. Variances may be granted when the applicant for the variance establishes that there are practical difficulties in complying with the official control. Variances may be granted when the applicant for the variance establishes that there are practical difficulties in complying with the official control. `Practical difficulties, 'as used in connection with the granting of a variance, means that the property owner proposes to use the property in a reasonable manner not permitted by an official control; the plight of the landowner is due to circumstances unigue to the property not created by the landolvner; and the variance, if granted will not alter the essential character of the locality. Economic considerations alone do not constitute practical difficulties. " FINDINGS The following bullets present the Planner's findings related to the Heinisch request for a variance, based on ! the statutory criteria for granting a variance. Each of the criteria are shown in italics: • The property owner propases to use the property in a reasonable manner under the conditions allowed by off cial control(s). Agriculture and Single Family Residenees are pernutted uses in the Agricultural Core(AG C)District, and are therefore reasonabie uses of the property. However,the applicants are requesting the following variance from the official controls: � A variance from the required lot size to allow a ten-acre lat. The development code specifies that lots in the AG C District be 2.0 to 5.0 Acres or 20 acres or greater. � A variance from the total nunnber and area of accessoty structures allowed in the AG C District. Lot size variance request analysis The applicants provided the follawing rationale for the requested lot size variance: • Expansion of the proposed 10-acre parcel to 20 aci•es would encompass an existing access road that provides access to the agi�icultural fields. The existing road is just south of the proposed 10-acre parcel, and is shown on the attached figures. They believe that this e�sting road needs to remain in order to provide access to the fields so that the agricultural activities can continue if the 10-acre parcel is sold in the future. The applicants indicated that other access options are limited,and that feasible accesses in other locations would divide existing fields, and require grading and a new culvert. • • A 2 to 5-acre parcel would make retention of the historic agricultural buildings more difficult or impossible. Heinisch Minor Subdivision and Va�lance Page 6 November 1, 2011 • Scandia, Minnesota The Planner suggests that�rantin�the variance to allow the 10-acre parcel in the AG C District based on the followin�: • Granting the variance will further the goals of the Comprehensive plan to preseive long-teran agricultural use and open space and protect natural resources in the AG C district. + The Development Code does allow fle�cibility in lot sizes for Open Space Conservation Subdivisions. OSCS require that at least 55 percent of the property be permanently dedication for agricultural use or open space. The minimum lot size allowed for OSCS is 1.5 acres, with no maximum size specified. The application of a conservation easement over 96%of the property owned by the applicant accomplishes the same goals as OSCS,and exceeds the required dedication of open space. Therefore, it is reasonable to allow the flexibility that would be allowed for an OSCS. � Allowing the 14-acre parcel would more easily allow maintenance of the two existing barn structures than a 2 to 5 acre lot, • Allowing the 10-acre parcel allows maintenance of the existing access road,and helps to maintain long-term agricultural use on the property. Accessory structure variance analysis � ' The applicants are requesting a variance from the allowed number and total area of accessory structures in • order to preserve two historic bam structures. The applicants noted the significance of the two traditional barns in the application, and indicated verbally that they would like to keep most or all of the accessory structures on the parcel. The Planning Commission should discuss the applicant's request and make a recoznmendation re�ardin�the number and area of accessoiy structures that will be permitted ta remain on the site. Issues to consider inciude: � Comprehensive Plan goals to preserve traditional agricultura] buildings and the agriculiural character of the community. � Potential concerns related to future incompatible use of the accessory structures • A garage is a necessary accessory structure in the local climate. • The practical d�culties are not caused by the landowner, and are unique to the property. The practical difficulties are caused by the location of the existing field and roadwayconfiguration, and by the location of the existing historic baxn structures on the property. The difFculties are unique to the historic development of the property, and were not created by the current landowner. • The va�•iance would not alter the e.ssential character of'the area. Granting the variances would help to protect the agiicultural character of the area, and to preserve and enhance existing natural resources. • Economic conditions alone shall not constihrte practical di�culties. • Heinisch Minor Subdivision and Variance Page 7 November 1, 2011 Scandia, Minnesota • The applicants indicated that the request for a 10-acre parcel was made ui part because a 10-acre parcel is znore saleable than a 20-acre parcel. However,they indicated that this economic consideration is not the only reason for the request. • Variances shall only be permrtted��hen they are in harmony with the generalpurposes and intent of the o�cial control. Granting the requested variances is in harmony with the purposes and intent of the Comprehensive Plan and Development Code as follows: o The variances will support protecting 290 acres with a permanent conseiva#ion easement that limits future use to agriculturai production,habitat and wildlife management, and open space. o The vviances will allow preservation of historic agricultural structures and maintain the nual character of Scandia. ACTION REQUESTED: The Planning Commission can recommend the following: l. Approval 2. Approval with conditions 3. Denial wittx findings 4. Table the request • PLANNING STAFF RECOMMENDATIONS: The Planner recommends tliat the Planning Commission approve the proposed minor subdivision of the property located at 23620 Olinda Trail North. The Planner also recommends that the Planning Commission approve the requested variances to allow a 10-acre parcel in the AG C District,and to allow some of the accessory structures to remain on t�e parcel,based on the findings noted above. The Planning Commission should xecommend the number and total area of accessoiy structures that may remain. The Planner recommends the following conditions for the subdivision: 1. The minor subdivision shall be in substantial compliance with Exhibit B included in the application. 2. The applicant shall estahlish a permanent conservation easeznent on the 290 acres of their property that are outside the 10-acre homesite. The permanent conservation easexnent shall prohibit future residential, commercial and industrial development on the parcel. 3. accessory structures totaling_square feet in area shall be pernutted to remain on the 10-acre parcel. All structures that are not permitted to remain shall be removed before the applicant records the 10-acre parcel. 4. The Appiicant shall pay the park dedication fee of$3,000 unless the Park Committee and City Council agree to waive the fee due to allowed public use of the property that will be pennanently protected by a conservation easement. 5. We do not meet the buitding limit#or 10 acres–have 10 butldings,2 corn cribs and a bunkfeeder plus the house and garage. 2. Two of the buildings are h(p roof barns that are hand hewn and wood pegged which makes them historical. Removing the pole buildings would destroy the rural characte�isti�of the farm. � � 3.
