07.a Resolution No. 2022-15 from April 6th Declaring-Sufficiency-of-Petition-and-Setting-a-Public-Hearing for Ped EasementRESOLUTION NO. 2022-15 A RESOLUTION DECLARING SUFFICIENCY OF PETITION AND SETTING A PUBLIC HEARING ON THE PROPOSED VACATION OF A PEDESTRIAN TRAIL EASEMENT IN THE CITY OF SCANDIA, COUNTY OF WASHINGTON, MINNESOTA WHEREAS, a petition signed by the majority of property owners abutting a portion of a pedestrian trail easement to Goose Lake in the City of Scandia was received by the City Clerk on the 30th day of March, 2022; and, WHEREAS, the petition requested that the City Council pursuant to Minnesota Statute §412.851 vacate a portion a recorded easement legally described as: The East 20.00 feet of the Northwest Quarter of the Southwest Quarter. AND That part of the East 20.00 feet of the Southwest Quarter of the Southwest Quarter lying North of the South 468.27 feet thereof. All in Section 11, Township 32 North, Range 20 West, Washington County, Minnesota. WHEREAS, the City Clerk has reviewed and examined the signatures on said petition and determined that such signatures constitute a majority of the landowners abutting upon the portion of the pedestrian trail easement to be vacated; and, WHEREAS, a copy of said petition and map is attached hereto. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCANDIA, MINNESOTA AS FOLLOWS: The City Council will consider the vacation of such pedestrian trail easement and a public hearing shall be held on such proposed vacation on the 21St day of June, 2022, in a meeting of the Scandia City Council beginning at 7:00 p.m. BE IT FURTHER RESOLVED that the City Clerk is hereby directed to give published, posted and mailed notice of such hearing as required by law.
