CC RESOLUTION NO. 2022-26
APPROVING A CONDITIONAL USE PERMIT FOR PARCEL 06.032.19.32.0003,
LOCATED AT 23290 QUENTIN AVENUE NORTH
WHEREAS, Donna Pickard, on behalf of property owners Randy and Kathy Ferrin,
made an application to request a Conditional Use Permit to have a ground-mounted Local Solar
Energy System (SES) exceed a footprint of 800 SF in size, located at 23290 Quentin Avenue
North; and
WHEREAS, the property is legally described as
PART OF THE NW 1/4 OF THE SW 1/4 OF SECTION 06, TOWNSHIP 032, RANGE
019, BEING THE SOUTH 322 FEET OF SAID QUARTER-QUARTER SECTION
LYING & BEING EAST OF HWY 95 SUBJECT TO EASEMENT; and
WHEREAS, the Planning Commission reviewed the request for the Conditional Use
Permit (CUP) at a duly noticed Public Hearing on July 5, 2022, and recommended that the City
Council approve the CUP, with conditions;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL
OF SCANDIA, WASHINGTON COUNTY, MINNESOTA, that it does hereby approve of a
CUP, to have a ground-mounted Local Solar Energy System (SES) exceed a footprint of 800 SF
in size, located at 23290 Quentin Avenue North, based on the following findings:
1. The proposed use is a permitted accessory use in the AG C zone and is not in conflict
with the Comprehensive Plan. It will not require new public facilities or impact the City’s
capital improvement plan.
2. The proposed use will generate electric power from the sun, which will be used on-site by
the landowner. Excess electricity will be sent into the grid to be used by other users. The
use will not create adverse impacts on the public health safety, morals, comfort or general
welfare of the public.
3. The site is already screened from other lots by existing vegetation, and is not able to be
seen from Quentin Avenue or Highway 95. It will not substantially diminish or impair
nearby property values or scenic views.
4. The proposed use will not noticeably change the site from what it is today, and therefore
will not impede development or improvement of surrounding properties.

5. Public facilities are not required to serve the proposed use.
6. The proposed use is consistent with the applicable regulations of the Agricultural Core
District, and is consistent with the requirements of Local SES as outline in Chapter Two,
Section 4.34(A) of the Development Code.
7. This proposed conditional use meets the general and specific performance standards of
the Development Code.
FURTHER BE IT RESOLVED that the following conditions of approval shall be met:
1. The proposed system shall not have a footprint exceeding 1,296 SF in size, as shown on
the plans submitted to the city and reviewed with this request.
2. The applicant shall adhere to the requirements of a Local SES, as outlined in Chapter
Two, Section 4.34(A) of the city’s Development Code.
3. The screening on the site shall be maintained at the current level so as to maintain 100%
screening from right-of-way and neighboring property.
4. The applicant shall secure all applicable local, state, and federal permits for the proposed
conditional use.
5. The applicant shall pay all fees and escrow costs related to the application.
