06.a2 Draft minutes 11-02-2022 Work Session November 2, 2022 A work session meeting of the Scandia City Council was held on the above date with modifications. The meeting was conducted in-person at the Scandia Community Center and over an electronic platform. All participants who joined the meeting remotely could hear each other and contribute to discussions. Mayor Christine Maefsky called the meeting to order at 6:31 p.m. The following were present: Council members Heather Benson, Jerry Cusick (arrived at 7:00 p.m.), Steve Kronmiller, Christine Maefsky, and Patti Ray. Staff present: City Administrator Ken Cammilleri and City Clerk Brenda Eklund. City Attorney Chris Nelson arrived at 7:35 p.m. APPROVAL OF THE AGENDA Ray, second by Benson, moved to approve the agenda as presented. Motion carried unanimously. INTERVIEW FIRMS FOR LEGAL PROSECUTION SERVICES At their meeting on August 16, 2022, the City Council directed staff to issue a Request for Proposals for Legal Prosecution Services. Three proposals were received by the September 23rd deadline. Interviews were conducted with the following firms: • GDO Law – Heather Monnens and Robb Olson • Mike Welch • Eckberg Lammers – Joe van Thomme and Tom Weidner The Council discussed the proposals. Mayor Maefsky said she called staff at Lake Elmo to inquire why Mr. Welch’s prosecution services ended there. Maefsky was told the Council chose to change firms with various contracted services, but the administrator did not have an issue with Mr. Welch’s work. Council member Ray said the cost difference is great, with Mr. Welch’s hourly rate of $110 a shock as to how low it is. Ray said that Mr. Welch is doing a great job and she would like to stick with him. Council member Benson said all are good firms, but there are enormous cost differences which cannot be ignored. Benson said she heard positive feedback from Forest Lake staff on Welch’s performance, saying service would not be much different with the other firms. The City Council will discuss the selection of a firm at their regular business meeting on November 15, 2022. DISCUSSION AND CONSIDERATION OF AN ON-CALL PLANNING SERVICES CONTRACT WITH BOLTON & MENK. At their meeting on October 18, 2022, the Council voted to enter into a contract with Bolton & Menk for On-Call Planning Services. A draft service agreement with Bolton & Menk was presented. Jenni Faulkner and TJ Hofner were present to discuss the contract and answer any questions. Scandia City Council Work Session November 2, 2022 Page 2 of 2 City Attorney Nelson said the contract looks good, with no recommended changes. Section 4.H.1 on page 6 was discussed, the reuse of documents. Council asked for alternative language regarding the release of documents. Administrator Cammilleri described the transition from current planning services with TKDA to Bolton & Menk, effective at the first of the year. A transitional period will begin in December with phase out of TKDA by year’s end. Cammilleri recommended Bolton & Menk set up regular office hours in Scandia, which Ms. Faulkner said they are prepared to do. Benson, second by Ray, moved to approve the contract with Bolton & Menk for On-Call Planning Services on the condition that Section 4.H.1 is reworded in a way that is agreeable to all parties. Motion carried 5-0. CLOSED SESSION – THE CITY COUNCIL WILL GO INTO CLOSED SESSION PURSUANT TO MINNESOTA STATUTES §13D.05, SUBDIVISION 3 (A), TO CONTINUE ITS EVALUATION OF THE PERFORMANCE OF THE CITY ADMINISTRATOR FROM OCTOBER 18, 2022. Maefsky, second by Ray, moved to enter a Closed Session Pursuant to Minnesota Statutes §13d.05, Subdivision 3 (A), to Continue Its Evaluation of the Performance of the City Administrator from October 18, 2022.
