8.e) Staff Report-Eckberg Lammers ���-� ECKBERG LAMMERS MEMORANDUM TO: Honorable Mayor and City Council Members FROM: Nicholas J. Vivian, City Attorney DATE: March 13, 2013 RE: Staff Report for March City Council Meeting Please be advised our office is presently working on the following matters on behalf of the City of Scandia. If you have any questions regarding these matters, please feel free to contact me. Simonson Minor Subdivision—DeveloUment Agreement The Council will receive a draft of the Development Agreement associated with the Simonson application for minor subdivision at its March meeting. If the minor subdivision is approved, the Development Agreement is a requirement of the City's Development Code. It will be presented for the Council's consideration along with the application for minor subdivision. Tiller Cornoration / Zavoral Conditional Use Permit Over the course of the last month, I have been working with Kristina to monitor the requirements of approval imposed by the Council including those contained within the Conditional Use Permit and the Conditional Use Permit Compliance and Reclamation Agreement. I will continue to provide support to Kristina in monitoring these requirements and obligations. Economic Development Authoritv Attorney Andy Pratt has been working with Kristina to compile and present information to the Council regarding the creation of an Economic Development Authority in the City of Scandia. Andy met with the Council at its workshop on March 12, 2013 to further discuss the concept and to review a draft Enabling Resolution and Bylaws. Personnel Policv Review Kristina asked our office to review four draft personnel policies for the Council's consideration. Jennifer Nodes, our employment attorney, worked with Kristina to review and comment on policies related to communications, electronic communications, CDL drug testing and Non-CDL drug testing. The policies were discussed at the Council's March 12 work session. Open Meetin�s Letter On March 11, 2013, I prepared and sent a letter outlining the requirements of Minnesota's Open Meeting's Law for each council member's consideration. The letter was generated at no expense to the City. From time to time, you will be receiving informational letters and memoranda from our office with recommendations for best practices in complying with Minnesota law. The letters and memoranda will generally focus on those laws which commonly create issues or subject Cities to liability. Comments Re�arding Transition The transition doesn't appear to have created any issues as our team has worked very well with Kristina. All matters previously in process with the City's prior counsel have been effectively transitioned. We appreciate the opportunity to represent the City of Scandia. The efforts of both the City and our team have allowed us become familiar with current issues very quickly. Please call with any comments or questions.
