Action Requested:
1. Approve Public Notice of Negotiation with Residential Solid Waste and Recycling
Collectors; and
2. Appoint one or two City Council members to participate in negotiations with Waste
Management (WM.)
Notice and Negotiation Period:
At the January 4, 2023 meeting, the Council gave staff direction to begin pursuing an organized
collection system for trash and recycling services. The next step is to provide formal notice to
the public and licensed solid waste haulers. The draft notice is attached, along with the draft
letter to WM inviting them to negotiate. The draft letter to WM includes a time frame for the
initial meeting. We will fill this in after consulting with the city members of the negotiating
committee.
We must negotiate with licensed collectors for at least 60 days; if agreement is not reached, then
we would proceed to the next step in the process (appointment of the Solid Waste Collections
Options Committee.) The 60-day period would begin upon publication of the notice (February
8) and end on April 9, 2023. Any agreement reached would likely come back to the Council no
sooner than the April 18 Council meeting.
We have been advised that we should expect WM to present a proposal to the city as part of this
process. The city should also prepare a list of items it requires in order to reach an agreement,
prior to the meeting. The city participants in the negotiation meeting(s) would include staff
(Administrator and Public Works Director) the City Attorney, and one or two Council
representatives. Washington County staff and Foth Consulting would provide expert advice to
the city in the negotiations. We will schedule a work session with the city team to prepare for the
meeting.
Solid Waste Collections Options Committee: After this initial 60-day negotiation period, if no
agreement is reached, the next step to implement organized collection would be to adopt a
resolution establishing a committee to identify, examine, evaluate and seek input regarding
various methods of organized collection. We are currently advertising for volunteers, so that we
are ready to appoint a committee if and when the time comes.
After the committee makes its report, the Council would hold a public hearing to decide whether
to implement organized collection. Organized collection may begin not sooner than six months
after the effective date of the decision. The hauler(s) would be chosen through an RFP process.
Ordinance Update: County staff has provided us with examples of ordinances from
communities using organized collection systems, so that we can begin preparing a draft to
replace our outdated City Code Chapter 52. It is possible other parts of the Code could be
affected (such as the Nuisance section.) We can begin working on the draft ordinance during the
negotiation period.

Pursuant to the Minnesota Organized Collection Statute, M.S. 115A.94 ("Statute"), the City of
Scandia has decided to initiate a 60-day period of meetings and negotiations exclusively with its
currently residential collectors to develop a proposal for the collection of solid waste and
recyclables. The 60-day period will commence on the date of this notice.
As required under the Statute, such meetings and negotiations are exclusive and will not be open
to the public. Limited information will be available given the confidential nature of this 60-day
process. Members of the public, however, will have an opportunity to be heard in the event an
agreement is reached, in which case the city will provide subsequent notice and information.
