BACKGROUND
The Debra Mitts Smith Living Trust own both the parcels with PID 3403220310031 (Parcel A)
& 3403220310032 (Parcel B). The trustees of the trust are Debra Smith and Marschall I. Smith.
The applicant is requesting approval for an easement vacation for the property with PID
3403220310031. The vacation will remove a drainage and utility easement that will no longer be
needed after a proposed lot line adjustment.
EVALUATION OF REQUEST
Staff Analysis
The proposed lot line adjustment will create a drainage and utility easement on Parcel A that will
no longer be required. New drainage and utility easements will be dedicated with the lot line
adjustment for the new shared lot lines between Parcel A and Parcel B.

The City must set the date to consider the vacation of the easement.
RECOMMENDATION
Staff recommends the City Council adopt the resolution as presented.

RESOLUTION NO. 03-21-23-01
A RESOLUTION SETTING A PUBLIC HEARING ON THE PROPOSED VACATION
OF DRAINAGE EASEMENT
WHEREAS, the City Council pursuant to Minnesota Statute § 412.851 desires to consider the
vacation of certain public drainage easements on the property (the “Property”) legally described
as:

WHEREAS, the drainage easements proposed to be vacated were created in Document No.
4265406, as filed in the Office of the County Recorder of Washington County, Minnesota. The
easements were dedicated via an easement agreement, and are legally described as follows:

WHEREAS, new drainage and wetland easements will be dedicated over the Property as part
of the a lot line adjustment, which can only be approved following a vacation of the existing
easement;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SCANDIA, MINNESOTA AS FOLLOWS:
The City Council will consider the vacation of such street and a public hearing shall be held on
such proposed vacation on the 18th day of April, 2023, located in the City Hall at 7:00 p.m.,
BE IT FURTHER RESOLVED that the City Clerk is hereby directed to give published, posted
and mailed notice of such hearing as required by law.
