9.f Resolution 06-21-16-06 Summary Publication of ordinance 172 extending the study period for the solar ordinanceCITY OF SCANDIA WASHINGTON COUNTY, MINNESOTA RESOLUTION NO. 06-21-16-06 A RESOLUTION OF THE CITY OF SCANDIA, WASHINGTON COUNTY, MINNESOTA, PROVIDING FOR THE SUMMARY PUBLICATION OF ORDINANCE No. 172, AN INTERIM ORDINANCE AMENDING INTERIM ORDINANCE 170, WHICH ESTABLISHED A STUDY PERIOD AND MORATORIUM FOR A PERIOD OF UP TO THREE (3) MONTHS PROHIBITING THE ACCEPTANCE OF ANY APPLICATION FOR A SOLAR FARM OR SOLAR GARDEN PURSUANT TO MINN. STAT. §462.355, Subd. 4., TO EXTEND THE STUDY PERIOD BY ONE (1) MONTH. WHEREAS, On April 19, 2016, at a Regular Meeting of the Scandia City Council, by majority vote, the City Council adopted Ordinance No. 170 which establishes a 3-month study period and moratorium prohibiting the acceptance of any application for a solar farm or solar garden and WHEREAS, On June 21, 2016, at a Regular Meeting of the Scandia City Council, by majority vote, the City Council adopted Ordinance No. 172 which amends Ordinance 170 to provide for one (1) additional month for the study period and moratorium prohibiting the acceptance of any application for a solar farm or solar garden and WHEREAS, State law requires that all ordinances adopted be published prior to becoming effective; and WHEREAS, the City Council for the City of Scandia has determined that publication of the title and a summary of Ordinance No. 172 would clearly inform the public of the intent and effect of the Ordinance; and WHEREAS, the City Council for the City of Scandia has reviewed the summary of Ordinance No. 172 attached and incorporated herein as Exhibit A; and WHEREAS, the City Council for the City of Scandia has determined that the text of the summary clearly informs the public of the intent and effect of Ordinance No. 172. NOW THEREFORE BE IT RESOLVED, the City Council for the City of Scandia hereby: 1. Approves the text of the summary of Ordinance No. 172 attached as Exhibit A. 2. Directs the City Clerk to post a copy of the entire text of Ordinance No. 172 in all public locations designated by the City Council. 3. Directs the City Clerk to publish the summary in the City’s legal newspaper within ten days. 4. Directs the City Clerk to file the executed Ordinance upon the books and records of the City along with proof of publication. Dated this 21st day of June, 2016. STAT. §462.355, Subd. 4., TO EXTEND THE STUDY PERIOD BY ONE (1) MONTH. On April 19, 2016, at a Regular Meeting of the Scandia City Council, by majority vote, the City Council adopted Ordinance No. 170, which authorizes a land-use planning study for the continued purpose of reviewing the City’s Comprehensive Plan and Development Code to determine if various public concerns are being sufficiently addressed or if changes may be necessary in order to protect the health, safety and welfare of the public from potential negative impacts that may be associated with solar farms or community solar gardens and places a moratorium of up to 3-months on accepting, issuing or processing any applications, permits, or otherwise allow the use of any land within the City for solar farms or community solar gardens until the City has completed studies and adopted any ordinance or amendments to the City’s Development Code or Comprehensive Plan. On June 21, 2016, at a Regular Meeting of the Scandia City Council, by majority vote, the City Council adopted Ordinance No. 172 which extends the study period and moratorium for up to one (1) additional month. A printed copy of the Ordinance is available for inspection by any person during regular office hours at City Hall or by standard or electronic mail.
