Background:
The Wastewater Advisory Committee has been working on a connection policy for the 201
Community Wastewater System since last year. At their April 24�h meeting, they finalized their
recommendation to the Council. A copy of which is included in your packet.
Issue:
Should the Council adopt the amendments to Ordinance 108 to include a policy for allowing
connections to the 201 Community Wastewater System?
Proposal Details:
The ordinance amendments included in your packet define sufficient capacity as the amount of
permitted flows less 10% for each section (Anderson-Erickson [A/E] and Bliss) of the 201
system. The A/E system has a design capacity of 6,700 gallons per day. The Bliss system is
designed for 19,800 gallons per day.
The most significant change is found in Section D. which would only allow properties that
cannot support an on-site sewage treatment system to connect to the 201 system. A survey and
analysis would be required from a licensed on-site sewage treatment system designer. There are
properties, such as the Continenzas, which could support an on-site system but for aesthetic
reasons have requested to hook up to the 201 system. Given that the system is at or near
capacity, the Wastewater Advisory Committee thought that connections after this should be only
allowed for those that do not have the option of an on-site system.
Another significant change is included in Section G. which would not allow for properties to
share septic tanks. When the system was originally installed adjoining properties were hooked
up through one septic tank and one connection to the main. As we have seen in neighboring
communities last year, when properties change hands this can create some difficulties.
Reguiring separate connections will eliminate any future disagreements over shared maintenance
costs and eliminate the requirement for cross easements for parcels. While it was acceptable in
the past and would be difficult to undo current shared systems, the Council should begin
implementing the new policy from this point going forward. The only exception would be if
someone could show non-economic hardships in meeting this requirement, then they could apply
for an exemption.
Lastly, Section H. clarifies the responsibility of the property of all costs associated with new
connections to the system.

AN ORDINANCE AMENDING ORDINANCE NO. 108: GOVERNING THE "201"
COMMUNITY SEWAGE TREATMENT SYSTEM
Section 1. Amendment. Ordinance No. 108, Section 8, CONNECTIONS TO THE
COMMLTNITY SEWAGE TREATMENT SYSTEM. shall be amended to read as follows:
SECTION 8. CONNECTIONS TO THE COMMUNITY SEWAGE TREATMENT
SYSTEM.
A. New connections to the community sewage treatment system shall be prohibited unless
Sufficient Capacity is available in all downstream facilities. Sufficient Capacity shall
be defined as a minimuin available ca�acitv of ]0% ot the permitted flows for the
facility. Flow evaluation shall be based on a minimum of 12 months of flow data. For
the Anderson-Erickson facilitv, sufficient capacity is available if the peak flow as
measured over the peak 3-dayperiod is less than 90% of the 6,700 al�per day
system design flow and the peak flow as measured on a monthlv basis is less than 90%
of the target monthly limit of 5,300 al� lons per day. For the Bliss facilitv sufficient
capacity is available if the peak flow as measured on a monthly basis is less than 90%
of 14,800 7a1� lons per day. 19,800 allons per day is the permitted flow less 5,000
;�allons per dav of reserve capacity.
f3. New connections to the communitv sewa�ystem shall be prohibited if the svstem is
within 10% of the pennit limits of non-flow samplin requirements.
C. Connections shall be limited to residential users only, and to properties adjacent to the
existing collection system.
�.1�. Onlv properties that are not able to accommodate a private onsite sewage treatment
svstem will be permitted to connect to the communitv sewage treatment system. Any
propert�owner requestin�a connection to the 201 system must first provide to the City
a survev and an analvsis from a Minn. R. 7080 (2011�licensed onsite sewa�e treatment
svstem designer documentingthat an onsite sewage treatment svstem is not feasible for
the property under the current Washin�ton Countv Individual Sewage Treatment
Syste�n Code.
a?:1�. No unauthorized person shall uncover, make any connections with, or opening into,
use, alter or disturb any portion of the system or appurtenance thereof without first
obtaining a written permit from the city or county as may be applicable.
I �'.I . All sewer connections shall conform to applicable requirements of the State Building
�T and Plumbing Code and all applicable rules and regulations of the city or county. All
connections shall be made gas-tight and water-tight, and verified by proper testing to
prevent the infusion of infiltration/inflow. Any deviation from the prescribed
procedures and materials shall be approved prior to installation. The connection and
inspection shall be n�ade under the supervision of the city Building Official or his
designee.
G. All ne�� connections to the svstem after the effective date of this Ordinance shall have
their own septic tank and pump tank. The sharin� of septic tanks among nei ng boring
properties is strictiv prohibited. If a dwelling currently sharin�a septic tank applies for
a permit that involves any material improvements that increase the flow, the property
owner will be rectuired to install a separate septic tank unless it can be proven that a
non-economic hardship exists in which case the �ropertv owner may apply to the City
Council for an eaemption from tl�is requirement.
�a.I l. New users connecting to the system shall pay to the city a sewer connection fee in
� accordance with the current fee schedule set by Ordinance of the City Council. In
addition to the connection tee, the new user is responsible for all of the costs associated
with hookin�p to the communit s�ge treatment system including but not limited
to the septic tank, pumps, wet wells, control panels, sewer laterals, road repair related to
the installation of the new ecLuipment and any costs incurred bv the Citv in the use of
en�ineers or other third party consultants.
Section 2. Effective Date. This ordinance shall be in full force and effect upon its adoption and
publication according to law.
