9.a PC Memo Rural Event Ordinance Memorandum To: Scandia Planning Commission Reference: Rural Event Ordinance Amendment Copies To: Neil Soltis, City Administrator Brenda Eklund, City Clerk Project No.: 16323.000 From: Sherri Buss, RLA AICP, Planner Routing: Date: August 28, 2017 Background The City Council recently reviewed Jeff Gacek’s application for an Annual Operating Permit for Redeemed Farm, a Rural Event Facility. The City’s review of his operations during the past year found that he substantially complied with all of the conditions for the IUP and AOP for the Rural Event Facility. Mr. Gacek asked if the review and approval of the AOP could be completed in the future using an administrative permit process to avoid the costs related to review by the City’s consultants and City Council. The Council agreed that this change could be made in the ordinance if an option was included that permitted the City to require Council review of the AOP if annual review of the facility indicated that it was not complying with the conditions of the IUP and AOP. Proposed Ordinance Amendment The current Rural Event Facility Ordinance does not specifically require Council review of the AOP, but this has been required for other AOP’s in the past, such as the aggregate mine projects. The City Administrator and Council have suggested an amendment to the ordinance to clarify that an Administrative permit process may be used, but that if the City’s inspection indicates non-compliance with the AOP or IUP conditions, the permit application shall be reviewed by the Council. The Planning Commission should discuss the proposed amendment at its meeting on September 5. A public hearing on the amendment could be scheduled at the October 3 meeting. City has received a request from Jeff Gacek to amend one of the conditions of his Interim Use permit, and the public hearing for this request will also be scheduled at the October 3 meeting.
