4.f) Res 07-01-14-06 Womack CUP CITY OF SCANDIA, MINNESOTA RESOLUTION NO. 07-01-14-06 APPROVING A CONDITIONAL USE PERMIT FOR 21090 OZARK COURT NORTH WHEREAS, Jean and Scott Womack made an application for a Conditional Use Permit to allow the operation of a Motor Vehicle Repair business on the property at 21090 Ozark Court North; and WHEREAS, the property is legally described as follows: Hawkinson Business Park, Lot 5, Block 1; and WHEREAS, the Planning Commission reviewed the request for the Conditional Use Permit at a duly noticed Public Hearing on July 1, 2014, and NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SCANDIA, WASHINGTON COUNTY, MINNESOTA, that it should and hereby does recommend approval of a Conditional Use Permit for the operation of a Motor Vehicle Repair business at 21090 Ozark Court North, , based on the following findings: 1. The proposed business complies with the Comprehensive Plan goals and policies for the Industrial Park (IP) Zoning District. It will not require additional public facilities, or impact the City’s Capital Improvement Plan. 2. The establishment, maintenance and operation of the business will need to comply with a Hazardous Waste Generator License and applicable federal state and local environmental regulations. The business shall obtain and comply with the license so that it will not be detrimental to or endanger the public health and safety. 3. The proposed use will not be injurious to the use and enjoyment of other industrial properties within the immediate vicinity. The business shall be operated within the building, and the site is screened from adjacent residential and business uses. 4. The Motor Vehicle Repair use will not impede the normal and orderly development and improvement of surrounding properties in the Industrial Park District. 5. Adequate public facilities and services are available to serve the proposed use. The use will not require additional streets, maintenance, police and fire services from the City. 6. The proposed use complies with the applicable regulations of the Zoning District. Resolution No.: 07-01-14-06 Page 2 of 2 7. The conditions for the Conditional Use Permit require that the use complies with the general and specific performance standards in the Zoning Ordinance. FURTHER BE IT RESOLVED, that the following conditions of approval shall be met: 1. The use and site operations shall be consistent with the application dated June 6, 2014. 2. The applicants shall obtain a Hazardous Waste Generator License from Washington County to operate at the new location. The business shall comply with the license requirements at all times. 3. All vehicle repair operations, parking and other business operations shall be conducted on paved surfaces. The applicants shall maintain the control of dust, erosion and surface drainage within the site. 4. No vehicles shall be parked on the premises other than those utilized by employees, customers awaiting service, or repaired vehicles waiting for pick up. Storage of salvage vehicles is prohibited. 5. Areas used for storage and disposal of trash, debris and discarded parts shall be fully screened from adjacent uses. The site shall be maintained in an orderly, clean and safe matter. No outside storage is permitted. 6. The applicants and owners shall maintain the existing screening on the property. 7. The applicants shall provide 8 parking spaces on the site. 8. The applicants shall submit a drawing of the proposed sign that would replace the existing sign on the property to the Zoning Administrator for approval. No additional signage is permitted for the business. 9. The Applicant shall pay all fees and escrows associated with this application.
